Terms of Service

Entity: CardLinkly LLC, an Arizona limited liability company (business address in Arizona), operating in Texas.
These Terms of Service (“Terms”) constitute a binding agreement between the user and CardLinkly LLC (“CardLinkly”). These Terms govern access to and use of cardlinkly.com, the CardLinkly mobile application, and all related products, features, and services (collectively, the “Service”). By accessing or using the Service, the user agrees to be bound by these Terms. A user who does not agree to these Terms must not access or use the Service.
1. Who can use CardLinkly
A user must be at least 16 years of age to create an account. A user who is under 18 years of age, or under the age of majority in the user’s jurisdiction of residence, may use CardLinkly only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on the user’s behalf. This requirement applies in particular to purchases and other paid features. By creating an account, the user represents that the applicable eligibility requirements are satisfied, that all information provided is accurate, and that such information will be kept current. The user is responsible for all activity conducted through the user’s account and for maintaining the confidentiality of login credentials.
2. Your cards and content
The user retains ownership of card details, photos, links, reviews, and other content submitted to the Service. By submitting content, the user grants CardLinkly a non-exclusive, worldwide, royalty-free license to host, use, display, reproduce, and distribute such content solely as necessary to operate, provide, and promote the Service, including published cards, reviews, and directory listings. The user is solely responsible for submitted content and represents that the user has all rights and permissions necessary to submit such content and that the content does not violate any law or infringe any third-party rights, including privacy, publicity, intellectual property, or proprietary rights.
3. Reviews and honesty
Reviews must be truthful, genuine, and based on actual experiences. Users must not:
- write fake, paid, or incentivized reviews, or reviews of your own card;
- use more than one account to leave multiple reviews of the same card; or
- solicit only positive reviews while suppressing negative ones.
A review receives a “Verified” badge only when it is associated with an actual tap of a CardLinkly card. CardLinkly may remove reviews or other content that violate these Terms or applicable law and may restrict, suspend, or terminate accounts that abuse the review system.
4. The “Find a Pro” directory & Sponsored placement
Organic rankings in the “Find a Pro” directory are based on factors such as verified reviews, engagement, and other relevance signals. Organic placement cannot be purchased. Paid placements are clearly labeled as “Sponsored” and do not alter the organic rankings displayed beneath them.
5. Acceptable use and content standards
Users must not:
- impersonate another person or business, or misrepresent your affiliation;
- post unlawful, harassing, hateful, deceptive, or infringing content;
- scrape, harvest, or bulk-download data, or copy a card onto an unauthorized tag or device;
- interfere with, overload, or attempt to breach the security of the Service; or
- use the Service to send spam or for any illegal purpose.
CardLinkly is a family-friendly, faith-based platform. In addition to the foregoing restrictions, users must not use the Service to create, share, promote, or advertise:
- vulgar, profane, obscene, or sexually explicit content, or nudity;
- sexually-oriented or adult services or work — including, without limitation, stripping or exotic dancing, escort services, and adult-content or pornographic platforms (for example, OnlyFans-style accounts); or
- content, conduct, or business that, in CardLinkly’s reasonable judgment, materially conflicts with CardLinkly’s published family-friendly and faith-based content standards or the biblical values on which CardLinkly is built.
These standards are central to CardLinkly’s mission and community expectations. If CardLinkly determines, through reasonable judgment, that an account, listing, card, review, business, or content violates this section, CardLinkly may remove the content, restrict visibility, suspend or terminate the account and any related accounts, and decline future access to the Service. Serious, unlawful, abusive, or repeated violations may result in permanent removal from the Service. Refunds or credits, including refunds for unused prepaid services, sponsored placements, subscriptions, or custom physical cards, will be handled in accordance with CardLinkly’s posted refund policy, applicable law, and the nature of the violation. CardLinkly is not required to provide an appeal process for enforcement decisions; however, CardLinkly may review a decision if the affected user contacts CardLinkly and provides relevant information.
6. Plans, billing & physical cards
CardLinkly may offer free and paid plans, including Pro, Business, Sponsored placement, and other add-ons. A free plan includes one digital card and a shareable QR code. Paid plans and add-ons provide access to additional features. When billing is enabled, subscriptions are billed in advance on a recurring basis through CardLinkly’s payment processor, Stripe, until canceled. A subscriber may cancel at any time, and the applicable plan will remain active through the end of the then-current paid period. Fees are disclosed at checkout.
Physical NFC cards are custom-made according to the user’s design and order. Because physical NFC cards are personalized, they are generally non-refundable except where a card arrives defective or damaged. In such circumstances, the user should contact CardLinkly for appropriate assistance. Prices, plans, and features may change, and CardLinkly will provide notice of material changes where required or appropriate.
7. Churches and community tools
An administrator who establishes a church or community workspace is responsible for the content posted by the administrator and authorized staff and for obtaining any necessary consents from members and families, including parental consent for children’s check-in. Check-in tools must be used only for their intended purpose and in accordance with applicable law. The Privacy Policy describes how children’s data is handled.
8. Our intellectual property
The CardLinkly name, logo, software, design, and related intellectual property are owned by CardLinkly LLC. These Terms do not grant any right to use CardLinkly branding except with CardLinkly’s prior written permission. User-submitted content remains owned by the applicable user.
9. Third-party services
The Service relies on third parties for hosting, authentication, storage, email delivery, payment processing, and other operational functions, and may include links to third-party websites or services. CardLinkly is not responsible for third-party services or content, which are governed by the applicable third party’s own terms and policies.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind. CardLinkly does not warrant that use of the Service will generate leads, customers, revenue, or any particular results. Reviews and listings reflect the views and information of users and do not constitute statements or endorsements by CardLinkly.
11. Limitation of liability
To the fullest extent permitted by law, CardLinkly and its owners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity. CardLinkly’s total liability for any claim arising out of or relating to the Service shall be limited to the greater of the amount paid to CardLinkly by the user during the 12 months preceding the claim or $100.
12. Indemnification
The user agrees to defend, indemnify, and hold harmless CardLinkly from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to the user’s content, use of the Service, violation of these Terms, or violation of applicable law.
13. Termination
A user may stop using the Service and delete the user’s account at any time. CardLinkly may suspend or close accounts that violate these Terms or applicable law. Provisions that by their nature should survive termination, including ownership, disclaimers, limitation of liability, indemnification, and dispute-related provisions, shall survive termination.
14. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules, except where applicable consumer-protection, privacy, data-security, or other mandatory laws of another jurisdiction require otherwise. The state and federal courts located in Arizona will have exclusive jurisdiction over any disputes, unless applicable law requires a different forum.
15. Changes to these Terms
CardLinkly may update these Terms from time to time. CardLinkly will update the “Last updated” date above and, where material changes are made, provide more prominent notice as appropriate or required by law. Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms.
